1. Introduction

1.1 Purpose of the Terms

These Terms of Use ("Terms") set forth the rules and conditions governing the use of the website www.usualai.me ("Usual.ai" or "the Platform"), which is operated and published by the team behind Usual.ai CTM Informatics Software INC. ("we," "our," or "us"). The purpose of these Terms is to define the rights, responsibilities, and obligations of both Usual.ai and its users ("you," "your," or "User") in relation to the AI-powered relationship guidance services and related technologies offered through the Platform. By outlining the framework for use of Usual.ai, these Terms aim to ensure transparency, safety, and lawful interaction between the Platform and its Users, in compliance with applicable international and local regulations, including but not limited to the Law on the Protection of Personal Data ("KVKK") and relevant data protection laws.

1.2 Acceptance of the Terms

By accessing or using Usual.ai, creating an account, completing the onboarding questionnaire, submitting relationship queries, or otherwise interacting with the Platform's AI-based guidance features, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with the Privacy Policy, Cookie Policy, and any other supplementary policies or guidelines that may apply. If you do not agree with any provision of these Terms, you must immediately cease using the Platform. Continued use of the Platform constitutes full acceptance of the Terms in force at the time of use.

Users who act on behalf of legal entities declare and warrant that they are duly authorized to accept these Terms on behalf of their organization.

1.3 Updates and Modifications

Usual.ai reserves the right to update, revise, or modify these Terms at any time, at its sole discretion. Such modifications may reflect changes in services, the introduction of new features, compliance with legal requirements, or updates to operational practices. All revisions will be published on the official website, and the "Last Updated" date will indicate the effective version. Users are encouraged to review these Terms periodically. Continued use of the Platform following any modification shall be deemed acceptance of the updated Terms. If a User does not agree with the revised version, their sole remedy is to discontinue use of the Platform.

2. About Usual.ai

2.1 Platform Overview

Usual.ai is an AI-powered relationship guidance platform designed to help individuals gain clarity and perspective on their personal relationships — including romantic partnerships, family dynamics, friendships, ex-partner situations, and workplace relationships. The Platform enables Users to describe their situation through a guided questionnaire and then engage in a conversational AI chat that provides personalized, non-judgmental guidance. Usual.ai is available twenty-four (24) hours a day, seven (7) days a week.

The Platform operates as an informational and guidance tool only. Usual.ai does not provide, and shall not be construed as providing, professional counseling, psychotherapy, psychiatric services, legal advice, or any other form of regulated professional service. All guidance provided through the Platform is for informational and self-reflective purposes only.

2.2 Publisher Information

Usual.ai is owned, developed, and operated by its founding team. Usual.ai is responsible for the technical infrastructure, operation, and maintenance of the Platform. The AI models and outputs accessible through the Platform may be powered by third-party AI providers whose technologies are integrated via APIs or other data exchange mechanisms.

2.3 Target Audience and Global Scope

Usual.ai is designed for adults worldwide who seek accessible, AI-assisted perspective on their personal relationships. The Platform's services are available internationally, and Users from all jurisdictions are welcome to register and utilize the Platform, provided that their use complies with applicable local laws and regulations.

2.4 Mental Health and Professional Services Disclaimer

IMPORTANT NOTICE: Usual.ai is not a substitute for professional mental health care, therapy, counseling, or crisis services. Usual.ai is an AI-powered informational tool, not a licensed mental health provider, therapist, counselor, or crisis intervention service. The guidance provided through the Platform is not therapy, is not clinical advice, and does not establish a professional relationship of any kind between the User and Usual.ai.

If you are experiencing a mental health crisis, thoughts of self-harm or suicide, domestic violence, abuse, or any other emergency situation, please immediately contact emergency services (112 in Turkiye, 911 in the US) or a licensed mental health professional. The Platform is not equipped or intended to handle crisis situations.

Usual.ai expressly disclaims any and all liability arising from reliance on Platform guidance as a substitute for professional mental health care, legal advice, or any other regulated professional service.

3. Account Registration and Access

3.1 User Eligibility

Use of Usual.ai is open to natural persons who are at least eighteen (18) years of age or the legal age of majority in their country of residence, whichever is greater. By registering an account or otherwise using the Platform, you represent and warrant that you meet these eligibility requirements and that you have full legal capacity to enter into and comply with this binding agreement.

The Platform is intended for adults navigating personal relationships and is strictly not intended for use by minors. Given the sensitive nature of relationship guidance content, Usual.ai reserves the right to require proof of age and to immediately restrict access where eligibility cannot be verified.

3.2 Account Creation and Security

Certain features of Usual.ai require the creation of a personal account. During registration, Users must provide accurate, complete, and current information. Any use of false, misleading, or impersonated information may result in immediate account suspension or termination.

Each User is solely responsible for safeguarding their login credentials. You agree not to disclose your credentials to any third party or allow others to use your account. Usual.ai shall not be liable for any unauthorized access or actions performed through your account resulting from your failure to maintain adequate security controls.

Users must immediately notify Usual.ai at support@usualai.me of any suspected unauthorized use, security breach, or compromise of their account credentials.

3.3 Account Responsibilities

Users are fully and solely responsible for all activities carried out under their account. By using the Platform, you agree to operate in good faith and only for lawful and ethical purposes consistent with these Terms. Users agree not to share, lease, sell, sublicense, or otherwise transfer their account access to any third party.

3.4 Account Suspension or Termination

Usual.ai reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or permanently terminate a User's account if it determines that the User has violated these Terms, engaged in fraudulent, unlawful, or abusive activity, or acted in a way that threatens the security, integrity, or reputation of the Platform.

4. Subscription and Pricing

4.1 Subscription Model

Usual.ai operates on a subscription-based membership model. The Platform is offered at a price as shown on the Platform. By subscribing, you expressly authorize Usual.ai to charge your selected payment method at the beginning of each billing cycle until you cancel your subscription.

4.2 Features Included

An active subscription provides Users with access to the following features:

  • Completion of the personalized onboarding questionnaire
  • Unlimited AI-powered conversational relationship guidance
  • Coverage of all relationship types, including romantic, family, friendship, ex-partner, and workplace relationships
  • Persistent conversation history and context memory within the Platform
  • Practical guidance scripts and language suggestions
  • Boundary-setting guidance and pattern identification
  • Emotional validation and perspective analysis
  • 24/7 availability and instant AI responses

4.3 Payment Methods and Processing

All payments are processed through authorized third-party payment processors integrated into the Platform. Users are responsible for ensuring that their payment information is accurate, valid, and current. In the event of a declined payment, the Platform may suspend access until payment is successfully processed.

4.4 Pricing Changes

Usual.ai reserves the right to revise subscription pricing at any time. Pricing changes will be communicated to active subscribers via email or in-Platform notification prior to the next billing date. Continued use of the subscription after the effective date of a price change constitutes acceptance of the new pricing.

4.5 Cancellation Policy

Users may cancel their subscription at any time through their account dashboard prior to the next billing date. Cancellation will take effect at the end of the current billing cycle. The User will retain access to the Platform until the end of the paid period. No partial refunds will be issued for the unused portion of a billing cycle.

4.6 Refund Policy

All subscription purchases are generally considered final and non-refundable given the digital and immediately accessible nature of the service. However, Usual.ai may, at its sole discretion, consider refund requests on a case-by-case basis in exceptional circumstances, including:

  • A duplicate charge caused by a verified technical error
  • Failure of subscription features to activate following successful payment
  • A confirmed unauthorized transaction conducted without the User's consent

Users requesting a refund must submit a written request to support@usualai.me within fourteen (14) days of the transaction date. Refunds will not be granted for dissatisfaction with the nature, quality, or outcomes of AI-generated guidance.

4.7 Currency and Taxation

All transactions are processed in US Dollars (USD). Users are responsible for any currency conversion fees applied by their financial institution. Users are solely responsible for determining and paying any applicable taxes, including VAT, GST, or other levies.

5. AI-Based Relationship Guidance Services

5.1 Scope of AI Services

Usual.ai provides Users with access to an AI-powered relationship guidance system. The Platform's AI capabilities include, but are not limited to:

  • Personalized, situation-specific relationship guidance
  • Analysis of relationship dynamics and pattern identification
  • Communication scripts and language suggestions for difficult conversations
  • Boundary-setting strategies and guidance
  • Emotional validation and outside perspective
  • Coverage of all relationship types: romantic, family, friendship, ex-partner, and workplace
  • Continuous conversational context memory within a session

5.2 Nature and Limitations of AI Guidance — Critical Notice

USERS EXPRESSLY ACKNOWLEDGE AND AGREE THAT ALL GUIDANCE PROVIDED BY THE USUAL.AI PLATFORM:

  • Is not therapy, counseling, or any form of regulated professional service;
  • Does not establish a therapeutic, clinical, or professional relationship of any kind;
  • Is not a substitute for licensed mental health professionals, relationship therapists, couples counselors, or legal advisors;
  • Is not intended to diagnose, treat, or address any mental health condition;
  • Is not guaranteed to be accurate, complete, or applicable to any specific individual situation; and
  • Must not be the sole basis for any major life decision, including but not limited to ending relationships, separation, divorce, child custody arrangements, or legal matters.

5.3 Sensitive Topics and Crisis Situations

Usual.ai is not a crisis service. If you or someone you know is at risk of self-harm, suicide, domestic violence, abuse, or any other emergency, please contact emergency services immediately.

5.4 Bias, Unbiased Perspective, and Limitations

Usual.ai is designed to provide balanced, non-judgmental perspective. However, Users acknowledge that AI systems may carry inherent biases from training data and that the guidance provided may not always reflect the full complexity of a situation. The Platform's guidance is based solely on the information provided by the User, which may be subjective, incomplete, or one-sided.

5.5 Third-Party AI Integrations

The AI functionalities offered on Usual.ai may be powered in whole or in part by third-party AI service providers. By using the Platform, Users acknowledge and consent that certain data, including queries and conversation content, may be temporarily transmitted to or processed by third-party systems solely for the purpose of delivering the requested service.

5.6 No Warranty on AI Outputs

Usual.ai makes no warranty, express or implied, regarding the accuracy, completeness, or fitness for purpose of any AI-generated guidance. The Platform may undergo scheduled maintenance or temporary interruptions.

6. User-Generated Content and Responsibilities

6.1 Submitting Queries and Personal Information

Usual.ai allows Users to submit relationship queries, personal narratives, and situational descriptions. By submitting such content, Users grant Usual.ai a limited, non-exclusive, revocable, and royalty-free license to process and store the submitted materials solely for the purpose of delivering the requested AI guidance service.

6.2 Privacy of Third Parties

The nature of relationship guidance requires Users to share information about third parties. Users acknowledge and agree that:

  • They will only share information about third parties to the extent necessary to receive the requested guidance;
  • They will not share identifying personal data of third parties (such as full names, addresses, or contact details) unless strictly necessary;
  • They bear sole responsibility for the disclosure of any third-party personal data through the Platform.

6.3 Legal Use and Compliance

All activities conducted on the Platform must comply with all applicable local, national, and international laws. The Platform may not be used for any activity that is illegal, unethical, or intended to deceive.

6.4 Prohibited Uses

Users are strictly prohibited from using the Platform to:

  • Violate or circumvent any law, regulation, or court order
  • Infringe upon any copyrights, trademarks, or intellectual property rights
  • Harass, stalk, defame, or collect personal information about third parties for harmful purposes
  • Submit fraudulent, false, or deliberately misleading information to manipulate AI outputs
  • Attempt to reverse-engineer, decompile, or extract source code, datasets, or architecture of any AI model
  • Scrape, harvest, or mass-download content from the Platform
  • Bypass subscription systems or usage restrictions
  • Engage in unauthorized automation or bot activity

6.5 User Liability and Indemnification

Users are fully, solely, and irrevocably liable for all content they submit through the Platform. By using the Platform, the User expressly agrees to indemnify, defend, and hold harmless Usual.ai, its affiliates, officers, directors, employees, licensors, agents, and partners (collectively, "Usual.ai Parties") from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to the User's use of the Platform.

7. Platform Responsibilities and Limitations

7.1 Service Availability

Usual.ai endeavors to provide continuous and reliable access to the Platform. However, availability may be affected by maintenance, upgrades, network failures, or events beyond Usual.ai's reasonable control. Usual.ai does not guarantee uninterrupted operation or error-free performance.

7.2 Data Protection and Security

Usual.ai is committed to safeguarding User data in accordance with the Law on the Protection of Personal Data (KVKK), the General Data Protection Regulation (GDPR), and other applicable privacy frameworks. The Platform employs encryption and secure access controls to protect personal information.

7.3 Disclaimer of Liability for AI Outputs and Advice Outcomes

CRITICAL DISCLAIMER: Usual.ai explicitly and irrevocably disclaims all liability for the outcomes of any decisions made by Users based on AI-generated guidance. Relationship decisions are deeply personal and consequential. Usual.ai provides informational perspective only.

To the maximum extent permitted by applicable law, Usual.ai and all AI-based services are provided "as is," "as available," and "with all faults." Usual.ai, its affiliates, licensors, and service providers make no warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy of data, or reliability of results.

In jurisdictions that do not permit the exclusion or limitation of certain implied warranties or liabilities, Usual.ai's total cumulative liability shall in no event exceed the total amount paid by the User for subscription services in the three (3) months preceding the event giving rise to the claim.

8. Data Privacy and Processing

8.1 Data Collection and Purpose

For further information regarding data collection, processing, storage, and your rights, please refer to the Privacy Policy and Cookie Policy available on www.usualai.me.

8.2 Sensitive Personal Data — Relationship and Emotional Data

The nature of this Platform involves the collection and processing of sensitive personal information, including emotional states, relationship circumstances, family dynamics, and personal narratives. Usual.ai treats all such data with heightened care and security measures.

Usual.ai does not sell User conversation data, personal narratives, or relationship information to third parties for commercial purposes. User stories and conversations are not used to train AI models unless the User provides separate, explicit consent for such use.

8.3 User Rights

Users have the right to access, rectify, erase, restrict processing of, and port their personal data. Users may submit requests via email to support@usualai.me.

8.4 Compliance with KVKK and GDPR

Usual.ai processes personal data in strict accordance with the Law on the Protection of Personal Data (No. 6698 — KVKK), the EU General Data Protection Regulation (GDPR), and relevant international standards.

9. Intellectual Property Rights

9.1 Platform Content

All materials available on Usual.ai — including the website design, graphical elements, user interface, text, source code, software frameworks, databases, and other proprietary components — are the exclusive property of Usual.ai or its licensors, protected under applicable copyright, trademark, patent, and trade secret laws.

9.2 Trademarks and Branding

All logos, trademarks, service marks, trade names, and branding elements appearing on the Platform are and shall remain the exclusive property of Usual.ai or its affiliates. Users are strictly prohibited from using, reproducing, or otherwise exploiting Usual.ai's trademarks without prior written authorization.

9.3 AI Output Usage

Subject to compliance with these Terms, Users retain the right to use AI-generated guidance outputs for personal, non-commercial purposes. Users acknowledge that AI-generated guidance outputs are informational content and may not qualify for intellectual property protection.

10. Limitation of Liability

10.1 Platform as an AI Guidance Tool Only

Usual.ai operates solely as a technological intermediary that facilitates access to AI-based relationship guidance tools. The Platform does not function as a mental health service provider, licensed counseling service, or any other form of regulated professional service.

10.2 Exclusions and Limitations

To the maximum extent permitted by law, Usual.ai, its affiliates, employees, and licensors disclaim all liability for any form of loss, damage, or injury — whether direct, indirect, incidental, consequential, exemplary, or punitive — arising out of or related to: the use of or inability to use the Platform; reliance on AI-generated guidance; decisions made by Users regarding their personal relationships; errors or limitations in AI-generated outputs; unauthorized access or data breaches; service interruptions; or failures of third-party integrations.

In no event shall Usual.ai's total aggregate liability exceed the total amount paid by that User for subscription services within the three (3) months immediately preceding the event giving rise to the claim.

10.3 Indemnification

Users agree to indemnify, defend, and hold harmless Usual.ai, its affiliates, officers, directors, employees, agents, licensors, and service partners from and against any and all claims, demands, actions, liabilities, losses, or expenses (including reasonable attorneys' fees) arising out of or related to the User's use or misuse of the Platform, any violation of these Terms or applicable law, or any breach of intellectual property or privacy rights.

11. Termination and Account Closure

11.1 Termination by User

Users may terminate their Usual.ai account at any time by following the in-Platform deletion process or by submitting a written request to support@usualai.me. Upon termination, all access to the Platform will cease. Any active subscription will be cancelled at the end of the current billing cycle.

11.2 Termination by Platform

Usual.ai reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or permanently terminate a User's account for reasons including violation of these Terms; use of the Platform for illegal or harmful purposes; fraudulent transactions or chargebacks; or interference with Platform operations or security.

11.3 Consequences of Termination

Upon termination, all rights and licenses granted under these Terms shall immediately cease. Obligations related to intellectual property, limitation of liability, indemnification, and dispute resolution shall survive termination.

12. Dispute Resolution and Governing Law

12.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkiye, without regard to its conflict of law principles.

12.2 Dispute Resolution

In the event of any dispute, the parties shall first seek to resolve the matter amicably through negotiation. Users are encouraged to contact support@usualai.me to initiate an internal resolution process.

(a) For Consumer Users: If the User qualifies as a "consumer" within the meaning of the Turkish Consumer Protection Law (Law No. 6502), disputes shall be submitted to the Consumer Arbitration Committee with jurisdiction over the User's place of residence.

(b) For Commercial or International Users: If the User does not qualify as a "consumer" under Turkish law, any dispute shall be finally settled by arbitration under the Istanbul Arbitration Centre (ISTAC) Arbitration Rules. The seat of arbitration shall be Istanbul, Turkiye.

12.3 Alternative Dispute Resolution

Before initiating formal legal proceedings, the parties shall make reasonable efforts to resolve disputes amicably through negotiation or mediation.

13. Miscellaneous Provisions

13.1 Entire Agreement

These Terms, together with Usual.ai's Privacy Policy, Refund Policy, and Cookie Policy, constitute the entire agreement between the User and Usual.ai concerning the use of the Platform and supersede all prior understandings, communications, or agreements, whether written or oral.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.

13.3 Waiver

No waiver by Usual.ai of any term, breach, or default shall be deemed a waiver of any subsequent breach unless expressly stated in writing.

13.4 Assignment

Users may not assign, transfer, or delegate any rights or obligations under these Terms without Usual.ai's prior written consent. Usual.ai may assign its rights and obligations to any affiliate, successor, or acquirer as part of a merger, reorganization, or sale of assets.
